PixPlace Community Content License

This PixPlace Community Content License (“License”) governs the rights you have with respect to content published in the public community feed on the PixPlace platform (“Community Content”), including AI-generated images, videos, Shorts, and extracted frames.
This License applies to all Community Content that authors have published with downloads and/or extraction enabled, unless a more restrictive license is explicitly stated on the post.
By downloading, extracting, or otherwise using Community Content, you agree to be bound by this License.
1. What Is Covered by This License
This License covers Community Content that satisfies all of the following conditions:
- The content is published in the PixPlace public community feed (not in a private Space);
- The post's author has not explicitly disabled downloading (
allowDownload: true); - For frame extraction: the post's author has not explicitly disabled frame extraction (
allowExtract: true); - The content has not been subsequently removed or hidden by the author or by PixPlace moderation.
Community Content does notinclude: (a) content in private Spaces; (b) posts for which the author has disabled downloads; (c) content of other users' accounts, messages, or profile data; or (d) PixPlace's own brand assets, logos, or trademarks.
2. Rights Granted
Subject to the terms and conditions of this License, each author of Community Content (the “Licensor”) grants you a worldwide, non-exclusive, royalty-free, irrevocable license to:
- Download Community Content in its available resolution;
- Use, copy, and distribute Community Content for any lawful purpose;
- Use commercially, including in advertising, product design, print-on-demand, video production, marketing campaigns, social media, and publications;
- Modify, adapt, and create derivative works from Community Content, including combining with other materials;
- Extract frames from video Community Content using PixPlace's built-in extraction tool, and use those extracted frames under the same terms;
- All of the above without attribution to the original author (though attribution is appreciated and encouraged).
3. Restrictions
The rights granted in Section 2 do not include the right to:
- Resell as standalone stock content. You may not upload Community Content to stock media marketplaces (e.g., Shutterstock, Adobe Stock, Getty Images, Freepik, or equivalent) as a primary product for resale to end customers, without adding substantial original creative value.
- Claim authorship. You may not falsely represent yourself as the creator of unmodified Community Content, or register it as your original work for copyright or trademark purposes.
- Misattribute. If you attribute the content, do not misattribute it to someone other than the actual PixPlace author.
- Automated bulk downloading for redistribution. You may not use bots, scrapers, or automated tools to bulk-download Community Content for the purpose of building a competing content library or service.
- Illegal use. You may not use Community Content in any way that violates applicable law, including but not limited to using it to harass, defame, or defraud individuals.
- Disable access controls. You may not circumvent any technical restrictions PixPlace has placed on download or extraction, including downloading from posts where the author has disabled these features.
- Content involving identifiable real persons. If Community Content contains the likeness of identifiable real persons, you must ensure your use of that content complies with applicable privacy and publicity rights laws. PixPlace does not warrant that Community Content is free of personality rights claims.
4. No Warranties Regarding Community Content
COMMUNITY CONTENT IS PROVIDED “AS IS.” PixPlace makes no warranties, express or implied, regarding Community Content, including but not limited to:
- That Community Content is free of third-party intellectual property claims (including underlying training data claims);
- That Community Content does not contain the likeness of real persons;
- That Community Content is accurate, appropriate, or suitable for your intended use;
- That Community Content complies with applicable laws in your jurisdiction;
- That the AI models used to generate Community Content do not incorporate copyrighted training data in ways that affect the legal status of the output in your jurisdiction.
The legal status of AI-generated content varies significantly by jurisdiction. You are solely responsible for ensuring that your use of Community Content complies with applicable law.
5. AI-Generated Content and Third-Party Intellectual Property
The majority of Community Content on PixPlace is AI-generated using third-party AI models (such as Stable Diffusion, Flux, Kling, and others). The intellectual property status of AI-generated content is evolving and varies by jurisdiction:
- United States: As of the date of this License, the U.S. Copyright Office has generally found that AI-generated works without sufficient human authorship are not eligible for copyright protection. Community Content generated entirely by AI without substantial human creative input may be in the public domain in the US.
- European Union: EU copyright law requires a human author for copyright to subsist. AI-generated content without sufficient human creative contribution may not be protected by copyright under EU law.
- Russia: Under the Civil Code of the Russian Federation (Part IV), works must have a human author to be protected by copyright. The legal status of AI-generated works in Russia is unsettled.
Notwithstanding the foregoing, where Community Content includes substantial human creative contribution (such as manual editing, selection, arrangement, or post-processing), the author may retain copyright in those contributions.
PixPlace does not provide legal advice. Consult a qualified attorney in your jurisdiction if you have questions about the intellectual property status of specific content.
6. DMCA and Takedowns
If you believe that Community Content infringes your copyright or other intellectual property rights, please submit a notice to [email protected] in accordance with our DMCA policy in the Terms of Service. We will review and act on valid notices promptly.
7. Attribution (Optional but Encouraged)
While not required by this License, if you choose to attribute Community Content, we suggest:
“[Content title or description] by [Author username] on PixPlace (pixplace.space)”
Attribution should not imply endorsement by the author of your product, service, or use of the content.
8. License Termination
This License automatically terminates with respect to any specific piece of Community Content if:
- The author removes or hides the post after you have downloaded the content (your pre-existing downloads and uses are not retroactively affected);
- PixPlace removes the content pursuant to a valid DMCA notice or moderation action;
- You materially breach the restrictions in Section 3.
9. Relationship to PixPlace Terms of Service
This License is incorporated into and forms part of the PixPlace Terms of Service. In the event of conflict between this License and the Terms of Service, the Terms of Service shall prevail. Your use of the Platform is also subject to the Privacy Policy and Cookie Policy.
10. Changes to This License
PixPlace may update this License from time to time. The revised License will apply to Community Content published after the effective date of the revision. Community Content published before a revision will remain subject to the License terms in effect at the time of publication.
